ESSV Terms & Conditions for Villa and resort reservations
ESSV is registered by the State of California, Florida and Washington as a Seller of Travel, Registration Numbers 2060094-40, ST37411 and UBI 602870637. Note: Registration as a Seller of Travel does not constitute approval by the States of California, Florida or Washington.
RESERVATIONS AND DEPOSITS
Reservations are accepted with a valid credit card as a guarantee. Reservation deposit is required (and automatically charged) within 24 hours of making a reservation. Final payment is due 45 days prior to arrival date. For holiday periods, final payment is due 90 days prior to arrival date. A refundable security deposit and accidental damage waiver is required for privately owned villa and select condominium reservations.
RATES
Price ranges advertised in the ESSV Vacation Guide are based on season, room type and number of guests. Rates are per night and do not include taxes or hotel service charges if applicable. Each reservation is for a specified number of guests and/or rooms. ESSV reserves the right to charge for additional guests and/or rooms. Do not exceed the maximum sleeping capacity of your reserved property.
CONFIRMATION DOCUMENTS
Confirmation documents are normally shipped 21 days prior to trip arrival date. These documents will not be released until final deposit and the required signed forms are received. Confirmation documents may be delayed and sent by e-mail due to late payment and/or non-receipt of required signed forms.
RATES AND ACCOMMODATION SUBSTITUTION
All prices, services and amenities are subject to change without notice. ESSV reserves the right to substitute similar services, accommodations or amenities if they become unavailable due to circumstances beyond our control or if a price, service or amenity was shown or quoted incorrectly. All prices are in U.S. Dollars ($USD).
AGE REQUIREMENTS
Most hotels have a minimum age requirement of 21; requirements vary from hotel to hotel. You must be a minimum age of 25 to rent a privately owned villa or condominium through ESSV. You must be a minimum age of 21 to rent a car and have a major credit card. Surcharges may apply for drivers ages 21-24.
PRIVATELY OWNED VILLAS AND CONDOMINIUMS
Cancellations: Payments are non-refundable and non-transferable, unless ESSV is able to re-rent the same property for the same rate and period of time, subject to a $200 cancellation fee.
Rescheduling: You may reschedule 45 days or more prior to your arrival date, with the same property and number of nights, for travel within one year of the original check-out date, subject to a $100 rescheduling fee. Rescheduled reservations are subject to availability and price increases, and the nightly rate is based on the new reservation dates.
Note: Holiday and Limited Offer reservations may not be rescheduled. Holiday reservations are subject to surcharges.
OCCUPANCY
• The total number of persons allowed in the property at any time is restricted to the stated limit for each property. Renter must disclose the number of persons in his party as well as the name of every member of his party. ESSV reserves the right to refuse entry or to expel persons not named as members of Renter’s party. If this limit is exceeded, then excess occupancy fees or eviction without refund is the penalty.
• No events, parties, weddings or other gatherings are allowed without express prior written permission from ESSV. Renter may not engage in any activities that disturb the quiet enjoyment of others; In addition to the rent, an event, party, wedding or gathering fee will be charged when and if permission is granted. Fees are subject to negotiation; a typical fee is equivalent to the rent for one night for the subject property.
• ADW coverage is void when maximum occupancy is exceeded.
HOTELS AND RESORTS
Changes: Once reservation is under deposit, a $25 per person fee applies to name changes and changes in travel arrangements.
Cancellations: Once reservation is under deposit, a fee of $100 per person applies. Reservations are non-refundable when cancelled 14 days or less prior to arrival date.
Holidays: During the holiday period of 12/17 to 1/4, cancellation fees are as follows: Once reservation is under deposit, a fee is $200/person applies. Cancellations made 60 days or less prior to arrival are non-refundable.
Note: Additional change and cancellation fees may be charged by hotels and resorts and these fees are assessed in addition to ESSV fees.
SERVICES AND ACTIVITIES
Changes: Once reservation is under deposit, a $50 per reservation fee applies to changes in travel arrangements.
Cancellations: Once reservation is under deposit, a fee of $50 per reservation applies. Reservations are non-refundable if cancellation is made 14 days or less prior to arrival.
Note: Additional change and cancellation fees may be charged by service and activity vendors and these fees are assessed in addition to ESSV fees.
REFUNDS
Any unused portion of accommodation, service or activity is non-refundable. All refund requests must be submitted in writing within 30 days of cancellation. Reservations made for travel during the holiday period (12/17-1/4) are subject to a surcharge, and cancellation fees may be up to 100% of payments.
TRAVEL INSURANCE
We recommend all travelers purchase travel insurance in the event of unforeseen circumstances. ESSV offers travel insurance arranged by Rental Guardian. Premium Travel insurance may be added up to 14 days from the time of booking. Standard Travel Insurance may be added up to 30 days prior to the arrival date, or up to the date of final payment, whichever comes first. ACCIDENTAL DAMAGE WAIVER
ADW is required for all private villa and select condo reservations. The fee for ADW is $59 per reservation for 3 and 4 star properties, $79 per reservation for 5 and 6 star properties and $99 per reservation for 6+ Platinum properties. The fee covers up to a $3,000 maximum benefit. ADW does not cover damages resulting from guest events, parties, weddings or other gatherings. ADW coverage excludes excessive cleaning fees and damages caused by abuse or acts of negligence.
CANCELLATION AND CHANGE WAIVER
For a fee of $49 per adult (18 years or older), you may obtain a Waiver for changes and/or cancellations of any part of your reservation up to the day of arrival. This prevents you from having to pay normally assessed change and cancellation fees. There is no fee for accompanying children under 18. The Waiver must be purchased when the reservation is made. It includes hotel and resort property accommodations, purchased from ESSV prior to departure. It does not include privately owned villas or condominiums and is not available for holiday reservations from 12/17 - 1/4. A written cancellation notice must be received by ESSV 24 hours or more prior to the scheduled vacation arrival date. Changes in occupancy for shared accommodations are not covered, nor are no-shows. This Waiver is non-refundable and is not an insurance policy.
